The law practice of Dr. Foerster Wiesner & Colleagues is legally constituted as a registered partnership under the German Civil Code.

The partnership is represented by partners Dr. Thomas Foerster, Wilko Wiesner, Sabine Kötter and Merle König each authorized to act as sole representative.

The professional practitioners at the law practice Dr. Foerster Wiesner & Colleagues are members of the Hamm Bar Association and admitted to the practice of law in Germany by the President of the Landgericht (Regional Court) Bielefeld and the President of the Hamm Bar Association. Their actions are subject to the corresponding professional rules and regulations.

For the duration of their admission to practice law by the Amtsgericht (local court) Rheda-Wiedenbrück, Dr. Foerster, Wilko Wiesner and Sabine Kötter have also been appointed notaries for the district of jurisdiction of the Oberlandesgericht (higher regional court) Hamm, which has designated Langenberg as their official seat.

  • Fachanwaltschaftsordnungen (FAO, Regulations concerning recognized specialist lawyers)
  • Code of Conduct of the Council of Bars and Law Societies of Europe (CCBE)

The professional conduct of notaries is chiefly governed by the following regulations:
  • Bundesnotarordnung (BNotO, Federal Notaries’ Code)
  • Beurkundungsgesetz (BeurkG, Official Recording of Documents Act)
  • Kostenordnung (KostO, Court Fee Rules)
  • Dienstordnung für Notarinnen und Notare (DONot, Service regulations for notaries)
  • Regulations of the Westphalian Notaries’ Association

The professional regulations may be inspected at the offices of the competent Notaries’ Association in Hamm. They may also be obtained via the hompage of the Federal Notaries’ Association (Bundesnotarkammer). The regulations of the Westphalian Notaries’ Association are available via their homepage (www.westfaelische-notarkammer.de) under “Fachinformationen” and then the heading “Normen”. 
The German Federal Lawyers’ Act (BRAO) stipulates that practising lawyers shall purchase and maintain professional liability insurance to provide cover of at least 250,000 euros. Details are set forth in section 51 BRAO.

Dr. Thomas Foerster, Dagmar Foerster, Wilko Wiesner, Sabine Kötter, Stefan Knöllner, Merle König and Manuela Kihm have purchased professional liability insurance for their work as lawyers from the Westfälische Provinzial Versicherung AG, Provinzial-Allee 1, 48159 Münster. This insurance does not cover indemnity claims from activities
  • via law practices or offices set up or maintained in other countries;
  • in connection with counselling on and dealing with non-European law;
  • performed by the lawyer before non-European courts.

The Federal Notaries’ Code (BNotO) enjoins notaries to take additional professional liability insurance providing cover of at least 500,000 euros. The details are set forth in section 19a BNotO.

Dr. Thomas Foerster, Wilko Wiesner and Sabine Kötter purchased professional liability insurance for their work as notaries from the Westfälische Provinzial Versicherung AG, Provinzial-Allee 1, 48159 Münster. The insurance cover does not include indemnity claims arising from activities in connection with offering advice on the laws of the United States of America (including the laws obtaining in individual states thereof) or Canada, unless the breach of official duty should lie in a failure to recognize the possibility that such could be governing law.

 
Professional rules of conduct (section 43a, par. 4 BRAO) forbid lawyers to represent opposing interests. Before agreeing to act for a client therefore, a case will be examined for conflicts of interest.
In cases of dispute between lawyers and their clients, application may be made to the out of court arbitration service of the regional Bar Association in Hamm (pursuant to section  73 par 2 no. 3 in conjunction with section 73 par. 5 BRAO) or the arbitration service of the legal profession (section 191f BRAO) within the Federal Bar Association, details available via their homepage  (www.brak.de),
